1. Before you list the unit

Register the rental with your municipality (1–2 unit non-owner-occupied) or obtain a DCA registration (3+ units); update it whenever ownership or agents change
Obtain the certificate of occupancy or re-rental inspection your town requires — requirements vary by municipality, so confirm with the clerk's office
Get the smoke detector, carbon monoxide, and fire extinguisher certificate (CSDCMFEC) before each new tenancy
File your liability insurance certificate with the municipality (P.L. 2022, c.92)
Pre-1978 building: schedule the lead-safe inspection and keep the certification current (P.L. 2021, c.182)
Determine the property's flood zone and flood history — you must disclose both before lease signing (P.L. 2023, c.93)
Check whether your municipality has rent control with the free lookup tool — if it does, register with the rent board before setting rent

2. Lease and required disclosures

Use a NJ-specific lease reviewed in the last two years — generic multistate forms miss NJ-only rules
Provide the Truth-in-Renting statement (most buildings with 2+ units; owner-occupied with three or fewer units are exempt)
Pre-1978: provide the federal lead-based paint disclosure and the EPA pamphlet, and keep the signed acknowledgment
Provide the written flood-risk disclosure form
Buildings of 3+ units: provide the annual window-guard notice for tenants with children 10 or under
Deliver the security deposit notice — bank name, address, account type, and amount — within 30 days of receiving the deposit

3. Security deposit handling

Collect no more than 1.5 times monthly rent in total deposits — pet deposits and prepaid last month count toward the cap
Hold the deposit in a separate interest-bearing account at a New Jersey banking institution — never commingled
Pay or credit the interest to the tenant every year
Annual deposit increases capped at 10% per year
Return the deposit within 30 days of move-out with an itemized statement (5 banking days after fire, flood, or condemnation)
Deduct only unpaid rent and damage beyond normal wear and tear — wrongful withholding exposes you to double damages plus attorney's fees (see the full deposit guide)

4. Screening and fair housing

Write your screening criteria down once and apply them to every applicant identically
Never decline a lawful source of income — housing vouchers included (NJ Law Against Discrimination)
Follow Fair Chance in Housing sequencing: no criminal-history questions until after a conditional offer, then an individualized assessment
Use FCRA-compliant screening reports and send adverse-action notices when you decline based on them
Keep every application and decision record — consistency is your defense

5. During the tenancy

Respond to habitability issues promptly — NJ tenants may repair and deduct if you don't
Renewals: any change in terms needs proper written notice — at least one full month for month-to-month tenancies
Rent-controlled municipality: file or register increases with the rent board before charging them
Re-issue the window-guard notice annually and at each renewal where required
Keep registrations current when the property changes hands or management
Remember evictions are court-only in NJ — lockouts and utility shutoffs are illegal (see the eviction process guide)

6. Recordkeeping

Signed lease, all disclosure acknowledgments, and the deposit notice in one file per tenancy
Dated move-in and move-out photos or video
A rent ledger showing every payment, charge, and credit
Maintenance requests, work orders, and invoices with dates
Copies of every registration, certificate, and inspection report
